This research examines the legitimacy and legal framework of digital sales contracts from the perspective of Islamic Sharia. With the rapid advancement of communication technologies, such as telephones and the internet, traditional methods of conducting sales contracts have evolved. The study aims to address how these modern tools can be used to facilitate sales contracts while adhering to Islamic legal principles. The research is divided into two main sections: the first defines key terms related to contracts and sales in Islamic law, and the second explores the legal implications of conducting sales contracts through modern communication methods. The study emphasizes that Islamic Sharia is comprehensive and adaptable to all times and places, making it essential to address contemporary issues like digital contracts. It highlights the importance of mutual consent, clarity of terms, and the absence of prohibited elements in ensuring the validity of digital sales contracts. The research also discusses the concept of Ijab (offer) and Qabul (acceptance) in the context of digital communication, arguing that these can be conveyed through modern tools like phone calls or emails. The research references the opinions of classical and contemporary Islamic scholars, as well as rulings from the Islamic Fiqh Council, which affirm the permissibility of digital contracts as long as they meet the essential conditions of a traditional contract. Challenges such as fraud, miscommunication, and technical issues are acknowledged, with recommendations for mitigating these risks through clear communication, verification processes, and adherence to Islamic legal principles. In conclusion, the research asserts that digital sales contracts are valid in Islamic law, provided they adhere to the necessary conditions of a traditional contract. It calls for the development of clear legal frameworks, investment in modern technology, and educational programs to ensure that digital contracts remain compliant with Sharia while leveraging the benefits of technological advancements. This study contributes to the ongoing discourse on the application of Islamic law in the digital age, ensuring that modern transactions align with the core values of justice, transparency, and mutual consent.
