Abstract This article delves into the constitutional safeguards for clean air within the Indian legal framework, examining how the Indian Constitution, through its various provisions and dynamic judicial interpretations, upholds the right to a pollution-free environment. Beginning with an overview of the escalating air pollution crisis in India, the article highlights the pivotal role of the Constitution in addressing this critical issue. It primarily focuses on Article 21, the Right to Life and Personal Liberty, demonstrating how the Indian judiciary has expansively interpreted this fundamental right to encompass the right to clean air, citing landmark judgments such as Subhash Kumar v. State of Bihar and the M.C. Mehta series of cases. Furthermore, the article explores the supportive roles of other fundamental rights, including Article 14 (Right to Equality) and Article 19 (Freedom of Speech and Profession), in the context of environmental protection. It also elucidates the significance of Directive Principles of State Policy, particularly Article 48A, which mandates the State's endeavor to protect and improve the environment, and the Fundamental Duty under Article 51A(g), which places a corresponding responsibility on citizens. The discussion extends to the legislative and judicial mechanisms for enforcement, including key environmental acts like the Air (Prevention and Control of Pollution) Act, 1981, and the Environment (Protection) Act, 1986, alongside the crucial role of Public Interest Litigation and specialized bodies like the National Green Tribunal. Finally, the article addresses implementation challenges, the constant balancing act between development and environment, and proposes future directions for strengthening these constitutional safeguards, reaffirming clean air as an integral component of a dignified life in India.
